Conditions Of Hire

  1. THE HIRER will remain on-site and be responsible for the supervision and care of the premises (that is the rooms hired and the common area of the hall), their fabric and contents, during the period of hire.

  2. THE HIRER will be responsible for the supervision and care of all occupants of the hall premises during the period of the hiring. THE HIRER will be responsible for supervising the behaviour of all persons using the premises, whatever their capacity including proper supervision of car-parking arrangements, particularly to avoid obstruction of the highway.

  3. THE HIRER must ensure that we hold relevant licences under Performing Right Society (PRS) and the Phonographic Performance Licence (PPL) or, where appropriate, you must hold such licence(s). THE HIRER has our permission for the performance of live music and the playing of recorded music under the Deregulation Act 2015.

  4. THE HIRER must restrict children from viewing age-restricted films classified according to the recommendations of the British Board of Film Classification. THE HIRER must ensure that you have the appropriate copyright licences for film. (The Deregulation Act 2015 requires you to have our written permission to show a film).

  5. It is the responsibility of THE HIRER to set up rooms in the format required within their hiring time, and allowing adequate time to clear and vacate the hall at the end of their hire.

  6. It is the responsibility of THE HIRER to ensure that they are fully conversant with the Fire & Evacuation procedures of the hall prior to the commencement of the hiring. That you as THE HIRER have had sight of this procedure on our website, under policies and procedures.

  7. THE HIRER shall not use the premises for any purpose other than that described in the hiring agreement and shall not sublet the premises. They shall not use or allow the premises to be used for any unlawful purpose or in any unlawful way. They shall not do or bring onto the premises anything, which may endanger the premises or render invalid any insurance policies relating to the premises.

  8. THE HIRER must ensure that the minimum of noise is made on arrival and departure, particularly late at night.

  9. THE HIRER must ensure that in order to avoid disturbing neighbours of the hall and avoid violent or criminal behaviour: (i) no one attending the event consumes excessive amounts of alcohol (ii) no illegal drugs are brought onto the premises. Drunk and disorderly behaviour is not permitted either on the premises or in its immediate vicinity. We will ask any person suspected of being drunk, under the influence of drugs or who is behaving in a violent or disorderly way to leave the premises in accordance with the Licensing Act 2003.

  10. THE HIRER shall ensure that nothing is done on or, in relation to, the Hall in contravention of the law relating to gaming, betting and lotteries.

  11. THE HIRER shall comply with all conditions and regulations made in respect of the hall by the Fire Authority, Local Authority, and Local Magistrates Court or otherwise, particularly in connection with any event which includes public dancing or music or other similar public entertainment or stage plays.

  12. THE HIRER shall, if preparing, serving or selling food observe all relevant food health and hygiene legislation and regulations. The premises are provided with a refrigerator and thermometer

  13. THE HIRER shall ensure that any electrical appliances brought into the Hall and used there, either by him or on his behalf, shall be safe, in good working order, and used in an appropriate manner.

  14. THE HIRER shall indemnify the Committee for the cost of repair, of any damage done, to any part of the Hall, (including the boundaries thereof,) or the contents of the Hall, which may occur as a result of the hiring.

  15. THE HIRER shall be responsible for leaving the premises in a clean and tidy condition.

  16. THE HIRER shall pay the required deposit as requested. This deposit secures a booking and will be returned at the end of the hire period, providing the hall is left in a reasonable condition, until this is paid the booking is not secure.

  17. The Balance shall be paid a minimum of 1 week prior to the booking date. If the HIRER fails to pay the balance within a week of the booking, then the booking will be cancelled.

  18. If THE HIRER runs significantly over time, a fee may be made payable and we reserve the right to withhold the deposit.

  19. The Committee reserve the right to withhold the deposit to cover costs, if the hall is not left in the condition found prior to the hire. If additional damage is caused then this will be discussed with the HIRER.

  20. If THE HIRER wishes to cancel a booking before the date of the event and the Committee is unable to conclude a replacement booking, the question of the repayment of any deposit already paid, or the further payment of any additional fee shall be at the discretion of the COMMITTEE.

  21. THE HIRER who has a regular weekly/monthly booking shall give adequate notice of 1 month if they wish to cancel a session, otherwise a regular fee will be incurred.

  22. THE HIRER who has a regular weekly/monthly booking who is unwell and cannot attend their booking as a one off, there will be no charge, providing the COMMITTEE is informed at the earliest possible time and it is agreed on by the COMMITTEE.

  23. THE HIRER who has a regular weekly/ monthly booking will book in advance dates on Hallmaster booking system, used by Southbourne Village Hall. This will ensure their place is secure.

  24. The COMMITTEE reserve the right to THE HIRER who has a regular weekly/ monthly booking, to allot a booked slot to another hirer, in the event of an absence of more than one month, unless secured by an agreed reservation fee, previously arranged by the COMMITTEE.

  25. In the event of the HIRER not complying with the conditions above, the COMMIITTEE cannot guarantee that the HIRERS regular slot is secure.

  26. THE COMMITTEE reserves the right to refuse a booking without notice or to cancel this hiring agreement at any time either before or during the term of the agreement upon giving 7 days notice in writing to the hirer, and any deposit shall be returned.

  27. The COMMITTEE reserve the right to alter charges.

  28. You must comply with all conditions and regulations made in respect of the premises by the Local Authority, the Licensing Authority, and our Fire Risk assessment or otherwise, particularly in connection with any event which constitutes regulated entertainment, at which alcohol is sold or provided or which is attended by children.

  29. You must also comply with our Health and Safety policy, and by requesting a booking and upon confirming the agreement, that you The HIRER have confirmed that you have read a copy of the Health and Safety policy, prior to commencement of hire.

  30. Safeguarding children, young people and vulnerable adults. You must ensure that any activities for children, young people and other vulnerable adults are only provided by fit and proper persons in accordance with the Safeguarding Vulnerable Groups Act 2006 and any subsequent legislation. (SVH Safeguarding policy can be found on the website and on the notice board).

  31. IN THE EVENT of the Hall or any part thereof being rendered unfit for the use for which it has been hired, the Committee shall not be liable to the hirer for any resulting loss or damage whatsoever.

  32. THE COMMITTEE does not accept responsibility for any stored equipment or other property brought on to or left at the premises, and all liability for loss or damage is hereby excluded. All equipment and other property (other than stored equipment) must be removed at the end of each hire.

  33. THE COMMITTEE does not permit fly posting or any other form of unauthorised advertisements for any event taking place at the premises, and must indemnify and keep indemnified us accordingly against all actions, claims and proceedings arising from any breach of this Condition. If you fail to observe this Condition you may be prosecuted by the local authority.

  34. THE COMMITTEE aim to offer the best WiFi service possible, we make no promise that the WiFi service will meet your requirements. We cannot guarantee that our WiFi service will be fault-free or accessible at all times.

    (ii) It is your responsibility to ensure that any WiFi enabled device used by you is compatible with our WiFi service and is switched on.

    (iii) We are not responsible for data, messages, or pages that you may lose or that become misdirected because of the interruptions or performance issues with our WiFi service or wireless communications networks generally.

  35. Wi Fi Services When using the Wi Fi service you agree at all times to be bound by the following provisions: (i) not to use the Wi Fi service for any for the following purposes: (a) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material or otherwise breaching any laws; (b) transmitting material that constitutes a criminal offence or encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice; (c)interfering with any other persons use or enjoyment of the Wi Fi service.

  36. CANDY FLOSS MACHINE- Due to the damage caused to the floor, we are unable to accept candy floss machines in the main hall.

The booking of the Hall by the Hirer indicates acceptance of all of the above conditions of hire. These conditions may not be varied in any way except without the prior written approval of the Committee.
